These Terms of Service ("Terms") govern your access to and use of the Provadyne software, website, and related services (collectively, the "Service"). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who We Are

The Service is provided by Provadyne, a product operated by Smolgear, an individual seller (sole proprietor) based in the Republic of Korea. Paid orders are sold and fulfilled through Paddle.com Market Ltd, which acts as the Merchant of Record (reseller) for all purchases. Paddle handles payment processing, invoicing, and the collection and remittance of applicable taxes (VAT/GST/sales tax). Paddle's Buyer Terms apply to the purchase transaction in addition to these Terms.

Provadyne performs static code analysis locally on your machine. The daemon runs on localhost and your source code is not transmitted to us. See our Privacy Policy for details, including optional Bring-Your-Own-Key (BYOK) AI features.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

Provadyne is a developer aid. Its findings are advisory and do not constitute a certification of compliance with MISRA, CERT, CWE, ISO 26262, or any other standard. You remain solely responsible for the correctness, safety, and certification of your code.

7. Limitation of Liability

To the maximum extent permitted by law, Provadyne shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law, including your mandatory statutory consumer rights.

We may update the Service and these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

9. Governing Law

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law rules. Disputes shall be subject to the jurisdiction of the courts of the Republic of Korea, except where mandatory consumer-protection law grants you the right to bring proceedings in your country of residence.
